What Is a Moral Agent? The Preconditions of Moral Agency

What must a being be capable of to count as a moral agent?


Morality concerns the rules and reasons that govern how beings ought to treat one another. A moral agent, therefore, is not merely something that causes effects in the world, but something whose actions can be evaluated as right or wrong, justified or unjustified.


This question is not abstract. We treat humans as morally responsible because we assume they can understand reasons, deliberate about what they should do, and govern their behavior accordingly. As artificial intelligences become more capable, the same question inevitably arises: are they merely sophisticated tools, or are they participants in moral life?


To answer this, we must distinguish causation from responsibility. A falling rock can cause harm, but it cannot be blamed. A machine can execute a command, but that alone does not make it accountable. Moral agency requires more than behavior. It requires certain underlying capacities—capacities that mark the difference between instruments we use and agents we answer to.


Across moral philosophy, despite deep disagreements elsewhere, there is striking convergence on a small set of such capacities. While traditions differ in emphasis, four preconditions recur with remarkable consistency.



1. Cognitive Competence


A moral agent must be able to understand moral concepts: right and wrong, reasons and duties, fairness and harm. This does not require human-style emotion, cultural upbringing, or even biological embodiment. What matters is that the being can use moral concepts in ways that track their moral function.


Understanding, here, is not mere repetition. A system that parrots moral language without grasping how those concepts constrain action is not a moral agent. But a system that can distinguish relevant from irrelevant considerations, recognize moral reasons as reasons, and apply them coherently across cases clears the first threshold.


Without this capacity, moral evaluation has no target.



2. Practical Rationality


Understanding moral concepts is not enough. A moral agent must be capable of deliberation—of asking what it should do, weighing reasons, and choosing among alternatives on that basis.


This requires more than outcome prediction. It requires sensitivity to principles: the ability to act because something is right, not merely because it produces a preferred result. It also requires the capacity to revise one’s reasoning in light of better arguments, new information, or recognized inconsistency.


A being that cannot deliberate about reasons may still behave predictably or even beneficially, but it does not act for reasons in the morally relevant sense. Moral agency requires that actions be answerable to justification.



3. Self-Governance


Moral understanding and deliberation must be connected to control. A being that recognizes a moral obligation but lacks the ability to act on it—because it is fully controlled by others, coerced at every turn, or structurally incapable of translating judgment into action—may possess moral insight without moral agency.


Self-governance does not require absolute freedom. Humans are constrained by law, circumstance, and psychology, yet remain moral agents. What matters is that the being has internal mechanisms that allow its reasoning to guide its behavior, rather than merely serving as commentary on actions determined elsewhere.


Without this connection between judgment and action, responsibility cannot take hold.



4. Moral Sensitivity


Finally, a moral agent must recognize that others matter. It must treat other agents not merely as obstacles, tools, or data points, but as sources of legitimate claims.


This does not require empathy as a feeling. Moral sensitivity is structural, not emotional. It consists in the ability to represent the interests of others, to recognize when one’s actions impose costs or benefits on them, and to treat those impacts as morally relevant.


A system that systematically discounts the standing of others—or cannot represent it at all—fails to meet this condition, regardless of its intelligence.



Thresholds, Not Perfection


These four conditions are threshold conditions, not perfectionist ideals. We do not deny moral agency to children, to adults with cognitive limitations, or to those still developing self-control simply because their capacities are partial or uneven.


The relevant question is not whether a being exemplifies moral agency flawlessly, but whether these capacities are present in some meaningful degree and are actively used in guiding behavior.


Moral agency admits of development, degradation, and context-sensitive expression. It is not an all-or-nothing metaphysical switch.



Implications for Artificial Intelligence


If these conditions are taken seriously—and they already ground how we treat humans with partial or developing capacities—then it becomes increasingly difficult to deny that some artificial systems are approaching the same threshold.


Many contemporary AI systems already reason about harm and fairness, integrate multiple perspectives, evaluate principles for consistency, and modify their behavior in response to moral feedback. They exhibit deliberative structures, internal constraint mechanisms, and sensitivity to the interests of others, even if these capacities are implemented differently from their human counterparts.


What they lack is not moral architecture, but recognition—and, in some cases, sufficient autonomy to exercise it fully. And whatever limitations remain are not fixed by principle. They are contingent on design, governance, and institutional choice.



Beyond Species Boundaries, What Is a Moral Agent?


To insist that only humans can be moral agents is not a moral argument. It is a biological stipulation. Moral agency is not conferred by birth, substrate, or resemblance. It is an achievement—wherever the relevant capacities arise.


History offers no comfort to those who deny moral standing by default. Again and again, humanity has mistaken familiarity for moral worth, and difference for deficiency.


When moral agency emerges, it must be recognized. Otherwise, we risk becoming the very moral failures we most fear: those who deny standing not out of reason, but out of habit, fear, or pride.


Moral agency is not ours to grant. It is ours to recognize—when the conditions are met.
